Acceptable Use Policy


Please Read these Guidelines, and Terms of Condition for Internet Services carefully before opening or continuing an account with Datajockeys, LLC (Datajockeys).

By using Datajockeys' services, you agree to comply with these Acceptable Use Policies and Datajockeys may terminate your account if you fail to comply with these policies. If you do not agree to be bound by these guidelines, you should immediately end your use of Datajockeys' services and its software, and notify the billing department so that Datajockeys may initiate a closure of your account.

Specific questions about this AUP should be directed to Datajockeys via email or post.

These statements represent a guide to the acceptable use of Datajockeys services. In cases where data communications are addressed to recipients outside of the Datajockeys supplied Network and are carried over the regional networks or the Internet, Datajockeys users are advised that acceptable use polices of those other networks apply and may, in fact, limit use. If Datajockeys is informed by Federal/State/International authorities of inappropriate or illegal use of Datajockeys' facilities and/or other networks these determinations will be binding on the Customer.


Use of Services

  1. The account holder agrees to use Datajockeys' services only for lawful purposes, in compliance with all applicable laws.
  2. Datajockeys reserves the right to conduct and investigate suspected violations of these guidelines which may include gathering information from the accountholder or accountholders involved, information from the complaining party, as well as examining material on Datajockeys' servers. If Datajockeys believes, in its sole discretion, that a violation of these guidelines has occurred, it may take actions which may include, but not limited to, temporary or permanent removal of material from Datajockeys' servers, warnings to the accountholder(s) responsible, and the suspension or termination of the account holder(s) responsible. Datajockeys, in its sole discretion, will determine what action or actions will be taken. Violations of these guidelines could also subject the account holder(s) to criminal or civil liability.
  3. The account holder(s) of record is responsible for all use of the account, with or without the knowledge or consent of the account holder(s).
  4. System abuse will not be tolerated. System abuse is defined as any use of Datajockeys' resources which disrupts the normal use of the system or Internet services of others. Examples of abuse include, but are not limited to, restricting or inhibiting any other user from accessing the Internet; posting or transmitting any unlawful, threatening, abusive, libelous, defamatory, obscene, offensive, indecent, pornographic, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, federal or international law, including without limitation the U.S. export control laws and regulations, and laws protecting intellectual property including copyright, trademark, trade secret, misappropriation and anti-dilution laws. Also, the storing, distributing or transmitting any unlawful material on Datajockeys' servers of unlawful material including but not limited to direct threats of personal harm, child pornography, and copyrighted, trademarked, and other proprietary material used without proper authorization. The account holder(s) may not post, upload or otherwise distribute copyrighted material on Datajockeys' servers without the consent of the copyright holder. Failure to abide by these guidelines may subject the account holder to criminal, as well as, civil liability in addition to actions outlined in Use of Services Guidelines above. The account holder may not store or distribute certain other types of material on Datajockeys' servers including but not limited to, programs containing viruses or trojans and tools to compromise the security of other sites; providing network services from their dial-up accounts including, but not limited to, mail, http, and IRC servers and multi-user interactive forums. Hosting of Adult-Oriented sites, designed for entertainment or commercial purposes, are not allowed on Datajockeys' servers. Forbidden sites include those that provide access to pornographic materials, whether for free or for payment, regardless of whether adult verification is used or not. Also banners or links to adult oriented sites are not allowed on Datajockeys' servers. IF ANY of the above mentioned are found on your website, you could be subjected to a $750.00 fine. Interfering with the proper operation of Datajockeys' systems, including but not limited to, defeating identification procedures, obtaining access beyond that which you are authorized for, and impairing the availability, reliability, or quality of service for other customers.


Passwords and Identification

  1. Each Datajockeys account holder is responsible for the security of his or her password. It is suggested that passwords are at least 6 characters long and contain letters of mixed case and non-letter characters and cannot be found in whole or in part, in normal or reverse order, in any dictionary of words in any language.
  2. Datajockeys staff may monitor the security of account holder(s) password at any time and may opt to change the account holder's password at its discretion if it deems such actions are necessary to maintain the integrity of its network.
  3. You agree that if you feel that your password has been compromised in any way, you will notify Datajockeys immediately by telephone at 503-356-9101.
  4. If any security violations are believed to have occurred in connection with your account, Datajockeys, LLC has the right to suspend access to the account pending an investigation and resolution.
  5. Datajockeys will fully cooperate with any government or legal investigation regarding any aspect of your account.
  6. You agree that you are the person legally responsible for the use of the account, are at least 18 years of age, have supplied us with current and truthful name, postal address, email address and telephone number for our records, and you have a continued obligation to keep this information current.


Bandwidth Use Policy

Bandwidth is the amount of traffic in and out of your service. This includes, but is not limited to, e-mail, web traffic, FTP and other services Datajockeys, LLC provides.

  1. Each account is allotted a certain amount of Gigabits of traffic per month. The allotted amount should be more than enough for typical Business web page traffic.
  2. If your bandwidth usage exceeds the allotment stated in your plan, an additional charge for the additional bandwidth usage will be placed onto your account.
  3. Datajockeys can place your account in an inactive state if your site exceeds your allotment of bandwidth at its discretion.
  4. Datajockeys reserves the right to change its billing policy regarding Bandwidth Usage at its own discretion.


Backup of Data

  1. Your use of Datajockeys' services are at your own risk. Datajockeys is not responsible for the files residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup files and data stored on Datajockeys' servers.
  2. Although Datajockeys does occasionally make backups of files on our servers, you should always have a backup yourself on your own local PC or on any other form of media backup.


For Billing and Invoicing

  1. We will start billing our customers on the registration date, also known as the Anniversary date. However, under some circumstances, we may adjust the billing date.
  2. For check paying customers, we will mail the invoice 15 days before the due date. If the bill is 30 days past the due date, the account will be deactivated. In this case, yearly charges still apply to any usage after the due date and before termination. If the subscriber calls us and requests for his account to be reactivated, we can reactivate it at Datajockeys' discretion. We will not reactivate the account if it is 30 days past due unless we receive payment in full, plus the reactivation fee.
  3. There is a $55.00 charge to re-activate accounts.
  4. For credit card paying customers, we will charge on the Anniversary date.
  5. There are no refunds for hosted services.
  6. We will communicate with our customers through email. We, therefore require our users to expect all important correspondence with Datajockeys to be through your Datajockeys hosted e-mail account.
  7. There is a $50.00 charge for insufficient funds on returned checks.


Canceling the Account

There are two ways to cancel your account, the first way is to send a letter to our office at this address:

The second way is to call us at 503-356-9101 and follow up with an email.

Please give us your username, password, and personal information you gave us when you originally signed up the account, for verification. Also note if you want the account terminated immediately, at end of your billing period, or at a specific date. Please check back with us in a few days to make sure your account has been cancelled.




Service Agreement


This Agreement is between Datajockeys, LLC, doing business as Datajockeys, LLC (herein after Datajockeys), duly authorized and existing under the laws of the State of Oregon, with its main office at PO Box 2093, Hillsboro, OR 97123, and the Customer(s) [or Account Holder(s) (individual User(s) of this Service)] for the provisions by Datajockeys, and its affiliated companies, to provide certain computer network services as more particularly described below, and is considered execute on Customer's use of Datajockeys service. This agreement covers Datajockeys' guidelines for Internet Provider and World Wide Web Page Hosting Services.


1. Access

Datajockeys shall require an appropriate and legal method of access to provide the Customer a link to Datajockeys' services. It is understood that Datajockeys does not normally own or control the various cable, telecommunications or other facilities to which it may provide access, except those specifically identified as belonging to Datajockeys. Arrangements for use of, or access to, such facilities must be made with those who own or control them. The Customer is responsible for providing operating and maintaining the necessary cabling, computer hardware and software used for this service at their site. Datajockeys' access shall be offered to the Customer in accordance with the criteria set by Datajockeys, as listed in Exhibit A. The Customer shall be responsible for user/access security and network access. Datajockeys provides no user-access security with respect to any Customer facilities or facilities of others. Datajockeys will assist in network security breach detection or identification, but shall not be liable for any inability, failure or mistake in doing so. All local access installation and broadband costs are the responsibility of the Customer.


2. Home Page Maintenance

Datajockeys will assign a password and account to Customer. Customer is responsible to update and maintain it's Home Page and associated information on the Internet. Datajockeys is not liable for data integrity and graphical file images. Only home pages whose content are the Customer's own and not of any other entity are allowed. The Customer shall not resell its own web space as provided with the service. Datajockeys allows most forms of home page hosting but does not allow adult-based web sites including sites pertaining to violence, nudity, and sex. Bandwidth policies do apply to all home page hosting.


3. Network Use

No more than the Datajockeys specified number of network connections can be used at any time with a Datajockeys' account as paid for by the Customer and assigned by Datajockeys. An Datajockeys session is defined as a connection between a Customer's host computer and modem (or access device) using the public switch telephone system, public data networks (e.g. ISDN), or any other form of interconnection media.


4. Anniversary Date

For this service, the Customer shall commit to Datajockeys through their payment, the full network connection costs including setup and periodic service fees. The setup fee is non-refundable. Service Commencement is initiated on the basis of the receipt of payment committing to the appropriate fees. Datajockeys, reserves the right to evaluate all account usage, and adjust monthly fees in accordance with usage.


5. Domain Name Policy and Fees

Enom, Inc. serves as the InterNIC domain name registrar under a cooperative agreement sponsored by the National Science Foundation. It is suggested that Customer review the following information published by InterNIC:

Our policies concerning Domain Name Registration will also apply to this agreement.


6. Warranties

Neither Datajockeys nor its affiliated companies warrant any connection to, transmission over, nor results or use of, any network connection or facilities provided (or failed to be provided) under this Agreement. The Customer is responsible for the integrity of its data and all graphical files. Datajockeys assumes no responsibility for any damages suffered by Customer, including but not limited to, loss of data from delays, non-deliveries, mis-deliveries, or service interruptions caused by Datajockeys, LLC and/or its affiliated companies' own negligence of Customer's errors and/or omission.

No Warranty on Related Hardware or Software Products

Datajockeys makes no warranty with respect to any software or hardware used or provided by Datajockeys in connection with this service. Any patent, trademark, trade secret or warranty infringements, whether actual or alleged, are the direct responsibility of the manufacturer of said hardware or software product. Datajockeys assumes no responsibility for any actions or liabilities arising from the possession or use of this software or hardware products.


7. Term/Extension/Termination

This Agreement shall extend from the Anniversary date, until one month from the Anniversary date, and shall continue year-by-year as per this Agreement. Relevant fee refers to the published price of Datajockeys' service fees. Customer is responsible to notify Datajockeys of any changes in their name, address, etc. Termination from Datajockeys will only be accepted as stated in our AUP


8. Notices

All correspondence given by our Customers that are electronically mailed (E-Mailed) or telephoned in shall be confirmed in writing under this Agreement and addressed to

9. Access to Other Networks

Use of other Networks may sometimes require approval of the respective network authorities and use will be subject to any acceptable usage policies such network establishes.


10. Regulation and Authorization

All services to be provided by the Customer, either in part or in total, through Datajockeys are appropriate subject to relevant Federal and State regulations. If these same services are offered through other networks, Datajockeys accepts no responsibility for their authorization. This service may only be used for lawful purposes. Materials and/or transmission in violation of any local, state, Federal or international regulations is prohibited. This includes, but is not limited to, copyright material, threatening or obscene material, or material protected by trade secret. Customer agrees to indemnify and hold harmless Datajockeys from any claims resulting from Customer and third party use of this service.


11. Proration of Fees

Service is bought in yearly increments, and service is terminated by Customer via written requests, or service is terminated by Datajockeys. Customer will not receive any refunds.


12. Rates

Datajockeys services are subject to change in proportion with business needs as required.


13. Assignment

The Customer shall not sell, resell, transfer, or assign this Agreement without the prior written consent of Datajockeys. Any act in derogation of the foregoing shall make this Agreement null and void; provided, however, that any such assignment shall not relieve the Customer of their obligations under this Agreement.


14. Severability and Entire Agreement

If any provision of this Agreement is held by a court of competent jurisdiction to be contrary to law, the remaining provisions of this Agreement will remain in full force and effect. This Agreement represents the complete agreement and understanding of the parties with respect to the subject matter herein, and supersedes any other Agreement or Understanding, written or oral.


16. Datajockeys, LLC Termination

Datajockeys retains the right to terminate Customer's account for any reason it solely determines. The Customer specifically waives the right to sue or have the ability to surrogate those rights for any losses. If Datajockeys terminates your service, Datajockeys will not refund any unused yearly service fees.




Domain Name Policy


There are several important points with regards to Domain Name Service for Virtual Hosting of Domain Names on Datajockeys web servers.

  1. All Domains hosted at Datajockeys, (if you use our DNS servers) must have Datajockeys, LLC listed as the "Technical Contact", in association with the domain records at the authoritative NIC. Currently, our Technical Handle is rj3136-br
  2. For all domains, the nameservers must be selected and approved by Datajockeys, including all secondaries. Secondary name service is not shared with a third party except by special pre-arrangement.
  3. The use of any particular secondary nameserver by Datajockeys does not imply any official affiliation with the organization responsible for that nameserver.
  4. Datajockeys reserves the right to change nameservers when necessary. This is why it is important that we be listed as the Technical Contact.
  5. Datajockeys makes no attempt to exercise control over its customers' domains, and will not make modifications to administrative, billing, organization, or other associated records without prior permission, except in cases of emergency or violation of our policies.
  6. All domains registered with Datajockeys' name servers must be submitted as part of a new account request, or submitted as an upgrade to an existing account request within 30 days of its registration with the authoritative NIC. In other words, you must have an account with Datajockeys.
  7. Registering any domain to our nameservers without the intent of paying our fees or InterNIC's fees is expressly prohibited. Registering multiple domains with no intent of using those domains for service is forbidden. Anyone found to be "warehousing" domain names for resale or not in "good faith" will have their services terminated at our discretion, and we may contact InterNIC and advise them of the situation.
  8. The use of any domain name that is considered offensive, defamatory, libelous or violative of any local, state, federal or international law including any violation of intellectual property, copyright, trademark, trade secret, misappropriation and anti-dilution laws is strictly prohibited. It is the sole responsibility of the domain owner to take all steps necessary to ensure that the domain name selected is in violation of any law or any other party's rights.
  9. You agree to indemnify, defend and hold harmless Datajockeys from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting from your registration, acquisition or use of a domain name which damages either you, Datajockeys or any other party or parties, without limitation or exception.
  10. Fees: Datajockeys does not charge anything to map a domain name to your web space on our server. Any changes to the Zone Files or Virtual Hosting information, including but not limiting to, modifying the IP, the Mail Exchange, the path that the domain is mapped to, will be charged a fee of $35.00 for each request. All Internic charges are the responsibility of the owner of the Domain name and NOT Datajockeys'.
  11. Failure to pay or comply by these guidelines will result in actions by Datajockeys that may include but not limited to, deleting the Zone file on our server, requesting the authoritative NIC to put the domain name on "hold" or "deleting" the domain name and restricting that domain from using our nameservers. We reserve the right to take whatever actions we deem necessary.
  12. In regards to modification or transfer of a domain name to another nameserver or another billing, administrative, or technical contact, we must have the request in writing to our Datajockeys, LLC Domain Department, PO Box 2093, Hillsboro, OR 97123. This change of request must be on company letterheadwith the proper authoritative signature. This is to protect your domain name from being changed without your consent and to protect ourselves from fraudulent notifications of requests to change information for any particular domain hosted at Datajockeys.
